Terms of Use

Please read these Terms carefully. They set out the rules for using the SaviSurg website and platform, including an important note on clinical responsibility for a tool used around the operating table.
01/Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of the SaviSurg website and platform (the “Service”). By accessing or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you confirm that you are authorized to bind that organization.
02/About the Service
SaviSurg is an offline-first platform that supports surgical teams with safety-checklist guidance, ambient operating-room capture, draft operative notes, and quality oversight. It is designed to build surgical-system capacity across Sub-Saharan Africa and the Caribbean.
03/Clinical responsibility
SaviSurg is a documentation and decision-support tool. It does not practice medicine and is not a substitute for professional clinical judgment.
Licensed clinicians remain fully responsible for every clinical decision and for the care they deliver. Draft operative notes and other generated outputs must be reviewed, corrected where necessary, and signed by the responsible surgeon before they are relied upon. The Service must not be used as the sole basis for any diagnostic, emergency, or treatment decision.
04/Eligibility and accounts
The Service is intended for authorized healthcare professionals and organizations. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
05/Acceptable use
- Do not use the Service unlawfully or in violation of any patient-privacy or data-protection obligation.
- Do not upload information you are not authorized to process, including without any patient consent required by law.
- Do not copy, reverse-engineer, resell, or attempt to derive the source code of the Service.
- Do not interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
06/Pilots and fees
Paid plans, including pilots from $500 per year, are governed by the order form or agreement you enter into with us. Fees are exclusive of taxes unless stated otherwise, and are due as set out in that agreement.
07/Your data
As between you and SaviSurg, you and your organization retain ownership of the information you provide. We process it in accordance with our Privacy Policyand any data-processing agreement between us. Each party will protect the other’s confidential information with reasonable care.
08/Intellectual property
The Service, including its software, design, and the SaviSurg name and marks, is owned by SaviSurg and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
09/Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that it will produce any particular clinical or operational outcome.
10/Limitation of liability
To the maximum extent permitted by law, SaviSurg will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months before the event giving rise to the claim.
11/Indemnification
You agree to indemnify and hold SaviSurg harmless from claims arising out of your misuse of the Service or your breach of these Terms, except to the extent caused by our own negligence or wilful misconduct.
12/Term and termination
These Terms apply while you use the Service. We may suspend or terminate access if you materially breach these Terms or where necessary to protect patients, users, or the Service. Provisions that by their nature should survive termination will survive.
13/Governing law
These Terms are governed by the laws of Saint Lucia, without regard to its conflict-of-laws rules. Where a paid agreement specifies a different governing law, that agreement controls for the paid Service.
14/Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
